E ancor prima dello scandalo dieselgate.

Credo di no.

By David Shepardson and Joel Schectman | WASHINGTON
Jan 6 Volkswagen and the Justice Department are nearing a deal to resolve criminal and civil allegations over the German automaker's diesel cheating while it won long-awaited approval from the Environmental Protection Agency to fix about 70,000 diesel vehicles, crucial steps toward moving past a scandal that has cost it billions of dollars and its reputation.

A successful settlement is critical to the automaker's goal of rebuilding its business in the United States, a market key to its long-term growth plans and where VW brand sales were down 8 percent last year. Volkswagen will show off a new gas powered SUV Sunday ahead of the Detroit auto show and will start selling a new larger U.S. built gas powered SUV later this year.

The deal with the Justice Department could cost more than $4 billion and could be announced as early as next week, according to several people familiar with the matter.

The approval on fixes with the EPA could help defray the total price tag of the scandal that may top $20 billion in the United States alone.

VW will also face the oversight of an independent monitor to ensure it complies with the settlement, which could include either a deferred prosecution agreement or guilty plea, and significant conditions requiring reforms, the people briefed on the talks said on Friday.

The people said Volkswagen will agree to a penalty of at least $3 billion - and possibly more than $4 billion - to resolve the government's investigation, though the deal remains under negotiation and could still fall apart.

A VW spokesman in Germany declined to comment, saying the automaker was in discussions with authorities, as did the Justice Department.

The world's second largest automaker is in intensive talks to resolve the U.S. criminal investigation into its diesel cheating that first came to light in September 2015 after it admitted to using sophisticated software to rig diesel emissions tests for more than six years.

PUBBLICITÀ

inRead invented by Teads

The talks have advanced as prosecutors and VW seek to resolve the case before President Barack Obama leaves office on Jan. 20, according to people familiar with the probe. If a deal is not reached before then it could significantly delay an agreement, those people said.

The U.S. investigation into VW - and a successful resolution - has faced hurdles as authorities at times struggled to obtain documents from VW and interviews with its Germany-based executives, according to people familiar with the investigation. VW has said it is fully cooperating.

VW had previously agreed to pay up to $17.5 billion to resolve claims by U.S. owners, federal and state regulators and dealers and admitted it had misled regulators for years about illicit software.

VW faces ongoing lawsuits from at least 19 U.S. states and a judge ruled this week it must face investor lawsuits in a California court.

The automaker will spend years fixing or buying back vehicles and making investments to boost zero emission vehicle infrastructure and must deposit nearly $3 billion in a trust to offset excess diesel emissions. It has also agreed to boost the number of electric vehicles it offers in California.

The EPA said Friday it had approved a fix for about 70,000 polluting Volkswagen diesel vehicles.

It involves new software available now. A second phase of the fix will start about a year from now when VW will install more software updates and new hardware, including a diesel particulate filter, diesel oxidation catalyst and NOx catalyst.

VW admitted in September 2015 to installing secret software known as "defeat devices" in 475,000 U.S. 2.0-liter diesel cars to cheat exhaust emissions tests and make them appear cleaner in testing. In reality, the vehicles emitted up to 40 times the legally allowable pollution levels.

The German automaker agreed to buy back those 475,000 polluting 2009-2015 vehicles last June at a cost of as much as $10.033 billion, or fix them if regulators approved. It still must win approval to fix about 400,000 of those vehicles.

The company later admitted to also using "defeat devices" in 3.0-liter vehicles. The 80,000 3.0-liter U.S. vehicles had an undeclared auxiliary emissions system that allowed them to emit up to nine times allowable limits. It reached a deal last month to offer to buy back 20,000 of the vehicles and fix the remainder, but still is awaiting approval for the fix.

The scandal hurt VW's global business and reputation, and led to the ouster of longtime chief executive Martin Winterkorn. VW has been barred from selling any new diesel cars in the United States since late 2015.

To date, only one VW employee has been criminally charged in the United States. James Liang, who worked for VW since 1983 and was part of a team of engineers who developed a diesel engine, pleaded guilty in September and is cooperating with prosecutors. (Editing by Soyoung Kim and Bernard Orr)

Staff and wire reports
Automotive News Europe
January 9, 2017 16:04 CET -- UPDATED: Jan 9 18:25 CET - adds VW brand CEO comments
DETROIT -- High-level Volkswagen executives could face charges in the U.S. over the automaker's emissions scandal after the FBI arrested one manager and said executive management was informed about the existence of an emissions cheating device but chose not to disclose it to U.S. regulators.

In a court filing Monday, the FBI accused VW of deliberately misleading regulators about cheating pollution tests in the U.S.

U.S. prosecutors plan to charge high-level VW executives based in Germany over the scandal, Bloomberg reported, citing a person familiar with the matter. The person did not say when charges will be filed against and whether they are planned against people still employed by the automaker.

Herbert Diess, VW brand chief, was asked about the charges on the sidelines of the Detroit auto show on Monday. He said: "Naturally I can say little about that. We simply have to accept that the investigations continue and we hope that we can soon reach a point where we put this behind us. But these are things that the management board itself has no knowledge of," he said referring to the investigations.

"Naturally this is not good news for us at the show."

Diess declined to comment when asked if he expected further arrests of VW executives.

VW employee Oliver Schmidt was arrested Saturday on charges of conspiracy to defraud the United States in connection with the scandal. Schmidt and other employees gave a presentation to VW's executive management about the defeat device on or about July 27, 2015, the FBI complaint said.

"In the presentation, VW employees assured VW executive management that U.S. regulators were not aware of the defeat device," the complaint said. "Rather than advocate for disclosure of the defeat device to U.S. regulators, VW executive management authorized its continued concealment."

In the meeting, Schmidt and other VW employees prepared a chart with possible consequences from a meeting with California regulators. One of the "negative for VW" consequences was "there could be an 'indictment,'" the complaint says.

VW said it could not comment on an ongoing legal matter. "Volkswagen continues to cooperate with the Department of Justice as we work to resolve remaining matters in the United States," the company said in a statement Monday. "It would not be appropriate to comment on any ongoing investigations or to discuss personnel matters.”

Cooperating witnesses

According to an affidavit filed by FBI Special Agent Ian Dinsmore, internal VW emails and accounts from two anonymous cooperating witnesses from inside VW's engine development department and from James Liang, an engine department employee who pleaded guilty to fraud charges in September 2016, provided enough evidence to charge Schmidt.

When the evidence first arose that something was off with VW's diesel engines, Schmidt wrote an email to another executive questioning whether the company should confess. "It should first be decided whether we are honest," he wrote. "If we are not honest, everything stays as it is."

After several meetings in Germany, Virginia, Michigan and California, Schmidt and other executives in August 2015 came up with a plan to conceal the defeat device from regulators. Schmidt wrote an email to another VW manager explaining that one employee would not be coming to a meeting with California regulators "so he would not have to consciously lie."

The complaint reads: "Nevertheless, in the summer of 2015, Schmidt agreed to travel to the United States to participate in direct conversations with U.S. regulators in which he intended to, and did, deceive and mislead U.S. regulators by offering reasons for the discrepancy other than the fact that VW was intentionally cheating U.S. emissions tests, in order to allow VW to continue to sell diesel vehicles in the United States."

An unnamed witness, referred to in the complaint as "CW1" met with California regulators on Aug. 19, 2015 and "disclosed, in direct contravention of instructions from his management, that certain VW diesel vehicles used different emissions treatment depending on whether the vehicles were on the (testing) dynamometer or on the road, thereby effectively admitting that VW had cheated U.S. emissions tests."

It was not immediately clear if or when Schmidt was terminated at VW. Schmidt headed the company's regulatory compliance office in the U.S. from 2014 to March 2015.

No extradition

The U.S. affidavit against Schmidt lays out what could be a road map to charges against higher-level executives. The German constitution bars extradition of German nationals to foreign countries other than European Union members states. The law allows it to hand over Germans to international tribunals such as the The Hague-based International Criminal Court.

If German nationals leave their home country, they could face the fate of German hedge fund manager Florian Homm, who in 2013 traveled from Germany to Italy only to be arrested at the Uffizi Gallery in Florence on U.S. charges.

Most senior VW officials are not attending this year's Detroit auto show, which is taking place this week. VW Group CEO Matthias Mueller stayed away from the show. VW brand chief Diess was the company's most senior representative.

VW admitted in September that it installed secret software that allowed U.S. vehicles to emit up to 40 times legally allowable pollution levels.

Volkswagen AG's (VOWG_p.DE) supervisory board is set to meet on Wednesday to approve a civil and criminal settlement with the U.S. Justice Department over the automaker's diesel emissions scandal that will include a penalty of about $4 billion, sources briefed on the matter said on Tuesday.

The deal, which is expected to include a guilty plea by the German automaker or one of its corporate entities for its conduct in misleading regulators about diesel emissions, comes as the automaker seeks to move past its "Dieselgate" scandal.

As part of a settlement VW would agree to significant reforms and face oversight by an independent monitor.

The company declined to comment.

VW admitted in September 2015 to installing secret software in hundreds of thousands of U.S. diesel cars to cheat exhaust emissions tests and make them appear cleaner than they were on the road, and that as many as 11 million vehicles could have similar software installed worldwide.

On Monday, a VW executive, the second VW employee charged by U.S. prosecutors, is accused of conspiracy to defraud the United States over the company's emissions cheating and the automaker was charged with concealing the cheating from regulators.

Volkswagen has agreed to spend up to $17.5 billion in the United States to resolve claims by U.S. regulators, owners and dealers and offered to buy back nearly 500,000 polluting vehicles.

Much of the company's senior management departed following the scandal, including Chief Executive Officer Martin Winterkorn.

U.S. Justice Department officials confirmed that unindicted co-conspirators remain in their ongoing investigation of Volkswagen Group's diesel emissions scandal and that three of the six VW executives already publicly charged are still employed by the automaker.

U.S. Attorney Barbara McQuade on Wednesday confirmed to Automotive News that executives Oliver Schmidt, Juergen Peter and Heinz-Jakob Neusser remain employed by VW, though Neusser is suspended.

Schmidt was arrested Saturday while vacationing in Miami and remains in custody in Florida. Before returning to Germany to serve as a principal deputy to Neusser in March 2015. Schmidt, 48, was a high-ranking VW executive in Auburn Hills, Michigan, who oversaw the automaker’s interactions with U.S. environmental regulators.

Neusser, the former head of development for the VW brand, is the highest ranking VW executive to date to be charged. The indictment indicates that Neusser “supervised a group of approximately 10,000 VW AG employees.”

The indictment identifies Peter as continuing to work in Germany for VW’s certification group, where he has worked since 1990. The indictment says Peter “was one of the liaisons between [U.S.] regulatory agencies and VW.”

Justice officials indicated that Richard Dorenkamp, former head of VW’s engine development after-treatment department, has retired, as has Bernd Gottweis, who was a supervisor in VW’s quality management and product safety department. Jens Hadler, who was head of VW brand’s engine development department, was “no longer working for the company,” Justice officials said.

VW will face oversight by an independent monitor for three years and has agreed to make significant reforms.

The company agreed to fire six employees, suspend eight and discipline three who participated in diesel misconduct, Reuters reported, but it was unclear which individuals were slated for those actions. The agreement still must be approved by U.S. District Judge Sean Cox in Detroit.

Spokespersons at the group’s headquarters in Wolfsburg, Germany, were not immediately reachable for comment. However, officials have in the past declined to comment on the specifics of the case as long as investigations continue, while pledging the company’s continued constructive cooperation with authorities.

In a statement Wednesday, a senior Volkswagen director, Stephan Weil, emphasized that an examination of the events leading up to the scandal would continue irrespective of the agreement and that he as head of Lower Saxony, a large shareholder, would continue to support this process.

VW obliged to cooperate

Meanwhile, McQuade, the U.S. Attorney from the Eastern District of Michigan in Detroit, confirmed that investigators continue to believe others were involved in the conspiracy, as laid out in today’s indictments. “The investigation does continue, and VW has an obligation to cooperate,” McQuade said.

At the Justice Department’s press conference today in Washington, D.C., FBI Deputy Director Andrew McCabe said it was “now clear that Volkswagen top executives knew about this illegal activity and kept their shareholders and the public in the dark.”

He said the government’s settlement with VW and the resulting indictments are “a great example of the fact that no corporation is too big, no corporation is too global, and no person is above the law.”

McQuade said the U.S. investigators have “worked closely and collaboratively with German prosecutors” as they developed their cases. “They’ve provided some evidence to us, and they know about ours,” she said.

‘Not some chump’

She also said that as the investigation widened, “some VW employees have been cooperative in providing information to us.” She said she didn’t have any information about potential extraditions from Germany but said that Justice officials “will explore our options for getting them here.”

McQuade said other automakers need to closely watch the VW case unfold, not just as a warning against wrongdoing but also as a message that such wrongdoing will eventually carry consequences.

“If you are an automaker that plays by the rules, you are not some chump who is going to be competitively disadvantaged because you chose to act within the law.”
